Currently BibliOZ.com is offering the following terms to booksellers who register and upload inventory

Our standard terms and conditions for trading follow. This is the BibliOZ Bookseller Agreement and forms part of the online registration process.

BIBLIOZ BOOKSELLER AGREEMENT (BBA)

Preamble

Please note: In this Agreement, "BibliOZ.com" means BiblioQuest International Pty Ltd., "Bookseller" means a book dealer who is a BibliOZ.com Bookseller Member and who has agreed to participate in this Program.

This BibliOZ Bookseller Agreement (BBA) governs your access to and use of www.biblioz.com and its bookseller management site www.biblioz.biz (the "Site") and the BibliOZ selling services operated through the Site and through BibliOZ Business Partners (the "Services"). The Services include sales through use of the Site, any other BibliOZ or BiblioQuest related websites and those of its Business Partners eg retail bookshops, libraries, online bookselling sites etc. This BBA may be amended by us from time to time. Latest versions of the BBA and current commission rates and payment schedules can be found in the Terms of Use link.

Please examine the entire Agreement carefully before agreeing to it.

When registering to use the Services you agree that the registration information you provide, including your name, address, phone number, e-mail address and payments information are true, current, accurate and complete.

Product Standards:

As a Bookseller, you warrant that the items you post for sale, and any related information will not:
(i) be counterfeit, fraudulent, or stolen;
(ii) contain pornography or be obscene;
(iii) be unlawfully threatening or harassing, defamatory or trade libelous, ,
(iv) infringe any third party's copyright or other proprietary rights, or
(v) contain any viruses, or other computer programming scripts that may damage or interfere with the Services.

Books that are mouldy, marked, dirty, unclean, or stained OR that are incomplete or have obscured text, and paperbacks without covers, should not be listed for sale unless specifically described as such.

Any items that are deemed unacceptable for sale by BibliOZ may be returned to you at your expense. You agree to comply with all applicable laws relating to sale of the items you list, including but not limited to import and export laws and prohibitions on the sales, distribution or offering for sale of specific items.

Rights

As a Bookseller you grant a non-exclusive, irrevocable, perpetual, fully paid, royalty free, transferable, global right and license to us, to use, reproduce, publish, translate, sublicense, copy, display and distribute, in whole or in part, any content you upload on the Site or a Business Partner site.

You acknowledge that the Site and Business Partner's sites contain information, data, software, type faces and other material ("Content") that are protected by trademarks, trade names, service marks, copyrights, trade secrets and other intellectual property rights, which are and shall remain the sole property of BibliOZ, its Business Partners and their licensors. You may not modify, reproduce, delete, add to, publish, distribute or create derivative works of the Content

Payments and Commissions: Booksellers will be paid according to the following payment schedule: For orders shipped in a given month, payment will be issued on or before the 15th of the following month. This payment cycle may be made more frequent in the future but will not be less than monthly. Our preferred method of payment will be by direct deposit to your bank account unless we mutually agree to payment by an alternative means where this is not possible.

Processing Orders: Booksellers in the BibliOZ.com Program should process their orders placed under this Program and ship the book(s) within two (2) business days. Booksellers will receive a second order email if the book order is not updated within five (5) days of ordering. Orders that have not been processed within seven (7) days will be cancelled. Booksellers have the right to refuse or reject any sales order placed through this Program or this Agreement.

Shipping: All booksellers will use a drop shipping method to the location which is given on the shipping manifest for each order. Booksellers are responsible for lost or damaged shipments, and it is strongly recommended that they purchase insurance and/or delivery confirmation. Booksellers will notify BibliOZ.com of book shipping or processing errors as soon as they become aware of them.

Returns: Booksellers will provide a refund for any book that the Bookseller has received payment for that arrives in a not-as-described condition or for books which are not received. The return must be made within 30 days of receipt by the purchaser. The cost of returning incorrectly described books is the responsibility of the Bookseller. Booksellers may dispute or refuse a return, and the final arbitrator for disputes will be BiblOZ.com.

Business Interruption and Reputation: BibliOZ.com and the Bookseller agree to avoid taking any action that could impede the sale of books or injure the reputation or integrity of the other party.

Termination: BibliOZ.com or the Bookseller may terminate this Agreement without notice for any reason. Upon termination of the Agreement, any amounts owed by any party are immediately due and payable and any orders in process at termination will be completed and paid according to the terms of this Agreement.

Relationship: No joint venture, partnership, employment or agency relationship exists between the Bookseller or BibliOZ.com through this Agreement or your participation in this program

No Warranty: BibliOZ.com provides this Internet website and all related services "as is" and without any warranty of any kind. We do not warrant that your access to this site and related services will be continuous, uninterrupted and secure; or that any and all information, products and services provided in connection with this site will be free from errors, viruses or other defects. We disclaim all warranties, express or implied, including all warranties of merchantability, fitness for a particular purpose and non-infringement. BibliOZ.com does not assume any liability or responsibility for the accuracy, completeness, or usefulness of any information, products, or services contained on this website.

Limitation of Liability: In no event will BibliOZ.com be liable for any direct, indirect, punitive, incidental, special, consequential or other damages arising out of or in any way connected with the use of this website or with the delay or inability to use this website, or any information, products and services obtained through this website, whether based on contract, tort, strict liability, or otherwise.

Governing Law: This Agreement and the rights of the parties is governed, construed and enforced in accordance with the laws of New South Wales, AUSTRALIA without recourse to any choice of law or venue laws. All disputes against Biblioz.com arising out of or related to this Agreement or website must be brought in New South Wales, AUSTRALIA
